This Client Briefing has been developed for Consult Australia members to provide to their clients, to assist in knowledge sharing between the parties on the use of warranties in agreements. The use of warranties is appropriate where a business can promise the delivery of goods or provision of services in a way that insurance cover can be obtained. In consultancy contracts, warranties should only be included if the party has sufficient control to deliver on the promise, and ideally has insurance that is able to cover the consultant if they fail to meet the promise.
