Liability Frameworks and Insurance - Client Briefing

This Client Briefing has been developed for Consult Australia members to provide to their clients, to assist in knowledge sharing between the parties on contractual liability frameworks and insurance. There are several ways a liability framework can be set up in a contract. Consult Australia advocates for a one cap on liability approach, as per AS4122-2010 where all liabilities are covered and how the consultant funds the liability is a matter for the consultant (e.g. off the balance sheet or via insurance). The consultant’s insurance is for the benefit of the consultant, not the client.
