Contract Checklist
This Contract Checklist is for internal use by Consult Australia member businesses. It should help team members reviewing contracts to identify some terms of concern. In this checklist, a term is of concern if it allocates liability to a consultant inappropriately and/or unnecessarily exposes a consultant’s professional indemnity insurance cover. This checklist also references standard contracts that generally align with standard PI insurance coverage – for example, AS4122-2010 General Conditions of Contract for Consultants, FIDIC Consultant Model Services Agreement, the Consult Australia Consultant Contract July 2022 and the Consult Australia Subconsultant Contract July 2022. This checklist can be used by members to assist with their internal contract reviews. It can also be used by members to identify and refer contracting terms of concern to Consult Australia for advocacy and advice purposes, noting that Consult Australia cannot provide legal advice but can provide information on issues faced by our sector and the industry. This checklist is not appropriate for a comprehensive contract review, but rather focuses on the top issues that Consult Australia has seen and regularly comments on.
